Resumen

Resumen: La Sentencia del Tribunal de Justicia (Sala Primera) de 25 de octubre de 2012, en el asunto C-133/11, Folien Fischer AG y AG contra Ritrama SpA establece la aplicación del forum delicti commissi del art. 5.3 del Reglamento Reglamento (CE) nº 44/2001 del Consejo, de 22 de diciembre de2000, relativo a la competencia judicial, el reconocimiento y la ejecución de resoluciones judiciales en materia civil y mercantil a las llamadas acciones declarativa negativas (negatives Feststellungsklage, en la terminología alemana).

Abstract: The Court of Justice of the European Union decided that a court may base its jurisdiction in respect of an action for a negative declaration in matters relating to tort, delict or quasi-delict on Article 5(3) of the Brussels I Regulation (ECJ 25 October 2012, C-133/11). According to the Court, if the relevant elements in the action for a negative declaration can show a connection with the State in which the damage occurred or in which the causal event giving rise to that damage took place (or, in the case of a potential tort or delict, the State in which the damage may occur).
