The purpose of this paper is to address the issues raised by the recent case law of the CJEU on Art. 82 GDPR. Although in theory the judgments analysed are intended to “clarify” the meaning of this provision, in some aspects they are not very enlightening, either by raising new doubts or by adopting confusing approaches to key elements of liability.
