Abstract

The CJEU has taken a further step in consolidating the principle of mutual recognition in matters of personal status, this time addressing the issue of gender identity. It considers that it is contrary to the right to free movement of persons within the European Union for Romania to require a new determination of gender identity under its legal system for a transsexual man with dual Romanian-British nationality who had adapted his name and gender identity in the United Kingdom.
