Towards a Common Framework under Regulation (EU) 650/2012 - Critical and prospective study

This study examines succession agreements within the framework of Regulation (EU) No 650/2012 from a comparative and critical perspective. The methodology combines a dogmatic and systematic analysis of national and European norms with the case law of the CJEU and of the main courts of Germany, Spain, France, Italy and the United Kingdom. It addresses the main tensions arising from regulatory diversity, especially regarding the reserved portion, public policy, and coordination among legal systems. The paper proposes common criteria to strengthen legal certainty, clarify the choice of law and limit the use of public policy.
