CJEU rulings on the EOI, overview to the e-evidence package and digital transmission

This paper aims to analyze the gathering of the cross-border criminal evidence from a threefold perspective. Firstly, it focuses on the most controversial issues arising from the practical application of the European Investigation Order, particularly in light of various rulings by the CJEU. Secondly, it explores the new European Preservation and Production Orders, as these are essential complements for obtaining electronic evidence. Finally, it examines the digital transmission of cross-border criminal evidence through a decentralised IT system. All of this will allow us to identify both the progress achieved and the main shortcomings in this field.
