This paper deals with the use of AI by judges and magistrates from a legal perspective, particularly marked by the Regulation (EU) 2024/1689, without neglecting related aspects. At the time of submission to the publisher, Instruction 2/2026 of the Spanish General Council of the Judiciary on the use of artificial intelligence systems in the exercise of judicial activity (BOE núm. 27, January 30, 2026) was published, corroborating what is explained here, and has been incorporated into the text.
