The Validity of Asymmetric Choice-of-Court Clauses

In a decision of 17 September 2025, the French Cour de cassation held that an asymmetric choice-of-court clause allowing one party to bring proceedings before “any other competent court”, as stipulated in a contract having no objective connecting factor with a third State that is neither a Member State of the European Union nor a party to the Lugano II Convention, must be interpreted as a reference to the jurisdictional rules of the Brussels I bis Regulation. Accordingly, the clause satisfies the requirement of certainty laid down in Article 25 of that Regulation.
