This article addresses the widespread problem of service contracts, starting from their configuration in Spain as a nominally existing but practically atypical concept due to the obsolescence of their legal basis. Against this backdrop, a comparative law study is carried out focusing on the legal systems of Italy and Portugal, analysing their responses to the inadequacy of their Civil Codes in relation to the service economy.
