The CJEU rules on the obligation to transcribe same-sex marriages between EU citizens

This paper addresses the recent CJEU’s ruling in the Wojewoda Mazowiecki case, in which the Court ruled again on the issue of recognition of same-sex marriages within the European Union. This paper provides an initial analysis of the ruling, exploring the areas of continuity and novelty in comparison to the Court’s previous rulings on the recognition of personal and family status between Member States. In particular, it examines the content and basis of the obligation to recognise and transcribe same-sex marriages as established by the Court, and considers the applicability of the principles issued in other cases.
