Abstract

The Rome I Regulation on the law applicable to contractual obligations has introduced new and substantial changes with respect to the previous law: The Rome Agreement. Some of the new aspects of the Rome I Regulation affect the general regimen of the lex contractus resolution, which includes one of the most common agreements in the current international and commercial practice: the international commercial agency agreement. This study analyzes the impact of the modifications in the Rome I Regulation, particularly the thorny issue of the law applicable to the international commercial agency agreements, be they “EC contracts” or “non-EC contracts”. The crux of the matter is the need to produce coherent, harmonious Community law on the subject.
