In this article we analyze the path employed in Spain to implement, at least in an informally way, the amendments made in 2014 with respect to the Maritime Labor Convention, 2006, ILO, which aim to establish a financial guarantee system in seafarers’ abandonment cases, as well as against claims related to death and prolonged disability of them, today contained in the Council Directive 2018/131, of January 23, 2018. Particularly, we reflect whether the established P&I private protection system conforms or not the objectives pursued in the international instrument, as well as the different difficulties that, from our internal legislation perspective, can arise from the said established private protection system.
