Abstract

The judgment rended by the Provincial Court of Toledo of March 7, 2018 resolves two questions regarding (1) the requirements of a divorce judgment obtained in Morocco to having the effect of res iudicata in Spain and (2) the jurisdiction of Spanish courts to hear the divorce case. The author of the comment disagrees with the reasoning used by the Court by omitting the application to the case of the Hispano-Moroccan Agreement of May 30, 1997 and the Regulation (EU) no 2201/2003, of Novem­ber 27 (Brussels II-bis).
