The application of the new provision of lis pendens regulated in the International Legal Cooperation in Civil Matters Act Matters is one of the aspects included in the decision adopted by the Provincial Court of Gerona. In this decision the Provincial Court also established the international jurisdiction in international matrimonial crises and parental responsability when the child has his/her habitual residence in a third State. In this paper we will analyses all these aspects.
