The ECJ in the Judgment of 16 january 2019, in the case C-386/17, Liberato, affirms that a breach of the rules on lis pendens, contained in Article 19 of Regulation nº 2201/2003 and Article 27 of Regulation nº 44/2001 cannot, in itself, justify non-recognition of a judgment on the ground that it is manifestly contrary to public policy in that Member Stated.
