Abstract

The rocketed developments in artificial intelligence field make necessary to review some topics on Patent Law, specially the concept of inventorship in order to asses if an artificial intelligence system can be considered as inventor. This paper examines this problem in the Spanish and European Law. Taking into account the analysis of the legal concept of inventor, we examine whether it is neces­sary to change the regulation to adapt it to the new challenges of the inventive capacity of the artificial intelligence systems.
