Abstract

This work makes a reading of the principles that govern the determination of the Law applicable to divorce in the Rome III Regulation: legal certainty, costs associated with international divorces, fight against Forum Shopping. Such principles are studied in the light of the judgment renderedby the ECJ 16 July 2020, C-249/19, JE vs. KF.
