Exploring the patriarchal limits of liberal democracy. Spanish feminist movement’s shift from institutional to protest struggle

Abstract

In this ruling, the Barcelona Provincial Court faces the recurring problem of extending to the consignee the effects of a choice of court agreement written down in the back of a bill of lading. Beyond legislative policy considerations, in the analyzed resolution the court is wrong when identifying the applicable legal instrument (Lugano Convention, instead of the Regulation Brussels I bis) and when
setting the normative value of the uses and customs in the maritime field.
