Abstract

In this ruling, the Barcelona Provincial Court faces the recurring problem of extending to the consignee the effects of a choice of court agreement written down in the back of a bill of lading. Beyond legislative policy considerations, in the analyzed resolution the court is wrong when identifying the applicable legal instrument (Lugano Convention, instead of the Regulation Brussels I bis) and when
setting the normative value of the uses and customs in the maritime field.
