Abstract

Having a default judgment been certified as a European Enforcement Order, its subsequent appeal reveals that notices were not served properly to the respondent, being so null and void. Considering these circumstances, the enforcing court opts for staying the enforcement proceedings under article 23(c) Regulation 805/2004.
