Abstract

This article deals with the Judgment of the Court (Fifth Chamber) of 24 March 2021, Case C-603/20 PPU, SS v MCP, related to the interpretation of Article 10 of Council Regulation (EC) 2201/2003. The Court considers that Article 10 is not applicable to determine jurisdiction if a child has acquired his or her habitual residence in a third State following a wrongful removal or retention in that State.
