Hadana, guardianship and child protection in Moroccan Family Law from Spanish public order

This paper deals with the compatibility of child protection and guardianship in Moroccan Family Law with Spanish public order, which avoid any discrimination on this matter. Specifically, Spanish statistics show the importance of public order, in accordance with annual naturalizations and several Moroccan discriminatory measures: child protection, foster placement with wilaya and kafala, legal guardianship (wilaya), guardianship (wilaya) of the Guardianship Judge, and guardianship (hadana) of parents. To this end, the paper addresses all legal issues regarding child protection and its measures, qualifying those that will not be able in Spain for discriminatory reasons and constitutional principles, highlighting equality and non-discrimination.
