Abstract

This paper aims to carry out a critical analysis of the inheritance rights that the Spanish legal system grants to the surviving spouse from a comparative perspective of Italian law, in the context of current social reality. Specifically, it is proposed that the desire to protect the surviving spouse should not be detrimental to the deceased’s freedom of disposition.
