When two spouses residing abroad and without common Spanish nationality file their consensual divorce petition in Spain, there are suitable instruments for our courts to hear the matter: The spanish autonomous system of international jurisdiction does not preclude submission agreements merely because they are a matter of family law. This is the error in which the commented order incurs, of course not at all expressive of a consolidated or majority current in the jurisprudence of our country.
