The legal framework of Directive (EU) 2020/1828 in relation to the judicial protection of the collective interests of consumers

The interest of the European Union to promote an internal market that guarantees the free movement of goods and services has coincided with the approval of several Directives in recent decades that have aimed at establishing mechanisms for the protection of consumer rights in all Member States. One of these instruments is Directive (EU) 2020/1828 of 25 November 2020 on representative actions for the protection of the collective interests of consumers. The transposition of this Directive will require a thorough revision of the collective actions in the Spanish Civil Procedure Act. This paper addresses the basic procedural aspects that must be amended.
