La naturaleza jurídica de la propiedad virtual. ¿Derecho real o derecho personal en el Metaverso?

La investigación analiza si la propiedad virtual constituye una categoría del derecho real de propiedad y construye su concepto jurídico. A través del análisis doctrinal y estudios de casos (Decentraland y Sandbox), demuestra que la propiedad virtual carece de atributos esenciales de los derechos reales como el carácter absoluto, la persecución, la inviolabilidad y la perpetuidad. Aunque la tokenización mediante NFTs otorga ciertas características como exclusividad y oponibilidad, no logra conferir todos los atributos de la propiedad real. El estudio concluye que la propiedad virtual no es una categoría del derecho real, sino un derecho personal derivado de contratos de uso o licencia entre el adquirente y el propietario de la plataforma. Creemos que debe privilegiarse la autonomía de la voluntad expresada en los contratos entre los propietarios de las plataformas y los adquirentes, pero sometidos a un conjunto de regulaciones que garanticen un cierto equilibrio negocial entre las partes.
