Abstract

The notion of ‘effectiveness’ of the law refers to a set of core phenomena that characterize a polity in which legality is the main focus of social integration. However, it is not a simple notion. In spite of their intuitive relationship, ‘effectiveness’ cannot be reduced to “compliance”. The relationship between these two dimensions of the legal system depends on a number of previous methodological options, which are to be specified. Furthermore, it worth be noticed that this issue becomes crucial in our times, because of the radical and accelerated mutation in the structure of legal forms.
