Resumen

El presente trabajo analiza los acuerdos de cooperación, tanto de soft law como de hard law, estipulados en el marco de la externalización de las fronteras, puesta en marcha por la UE y sus Estados miembros en la última década, a fin de bloquear los ingentes flujos migratorios hacia Europa. De forma más específica, el estudio se centrará en la respuesta de Italia y Dinamarca, que han reforzado esta estrategia, convirtiéndose en dos referentes, y en el modelo de la UE, que ha adquirido autonomía y caracteres propios. El análisis de cómo está evolucionando esta política, de sus tendencias y las persistentes incompatibilidades con los estándares mínimos de tutela tiene el objetivo de comprender si es posible encontrar fórmulas para que en estos contextos extraterritoriales se puedan respetar los derechos humanos fundamentales.
