Gender-based persecution refers to situations in which women are the object of violence, discrimination or persecution because they are women. This paper addresses the analysis carried out by various international bodies on gender-related claims for asylum and refuge. The purpose of this article is to determine whether the treatment received by women who turn to international bodies in order to halt their expulsion processes once the procedural process in the States parties to international instruments has been completed is consistent. To this end, the decisions of the Committee that oversees compliance with the Convention on
the Elimination of All Forms of Discrimination against Women, the European Court of Human Rights and the Court of Justice of the European Union will be analysed.
