The paper analyses the recent strengthening of regulatory powers in labour matters as a response to the difficulties of the legislative procedure. It examines two major initiatives –the draft Royal Decrees on working-time recording and on the transposition of Directive (EU) 2022/2041 on adequate minimum wages in the European Union together with the development of the rules governing the application of the statutory minimum wage –from the perspectives of both the material and the formal reservation of law, as well as the principle of normative hierarchy.
