The dismissal letter as a guarantee of the employee’s right to defence. A matter for reconsideration

The dismissal letter has traditionally been regarded as a safeguard of the employee’s rights to a defence; however, there are well-founded reasons that invite a reconsideration of this assumption. In this regard, the present study seeks to explore the relationship between the dismissal letter and the employee’s rights of defence, with the aim of determining whether this formal requirement genuinely constitutes a guarantee of such rights.
