Abstract

Before the emergence of AI, issues such as the handling of digital evidence by labor inspectors when it comes from private conversations, particularly via WhatsApp, were already controversial, given the significant legislative shortcomings in this area. In any case, the spectacular advances in computing with AI have sparked debates about labor inspection, both in terms of its organic existence and its modus operandi. New technologies enable the General Treasury of Social Security to carry out its own checks on compliance with contribution obligations, and automated administrative penalties are becoming more common, reviving old debates about the principle of culpability.
