Abstract

Since the early 1990s, research has been carried out on automated emotion recognition systems. These automated emotion recognition systems, which are based on biometric data (face, voice, body movement, etc.), may be a potential source of worker information for companies. The paper analyses the new Euro­pean regulation which includes those mentioned systems on twofold purpose. First, to identify the scope and content of the obligations and prohibitions of companies that process this type of personal data with the support of artificial intelligence; and second, to explain that emotion recognition systems in the labor setting are a qualitative leap as compared to traditional control measures (video surveillance, email, Internet, computer and similar devices). It is shown that these new generation control measures may place employees in situations of extreme vulnerability and therefore require additional guarantees.
