Abstract

The emergence of digital content creators (influencers, bloggers, instagrammers, tik-tokers, youtubers, etc.) requires, from a labour law perspective, a reflection on the nature of their activities. The purpose of this is to identify the possible concurrence of the characteristic features of an employment relationship and, therefore, the possible consideration of them as employees, hence their inclusion in the scope of application of labour law. The plurality of the activities carried out by these digital content creators opens up a reflection on their possible consideration as artists, trade representatives, or standard’ employment relationship. Are we facing new grey areas in labour law?
