The article compiles information about the acts of violence suffered by lesbian, gay, bisexual, trans or transgender (LGBT) people, in freedom and in prison, within some state members of the Organization of American States (OAS). In this way, the international human rights protection instruments of the Universal and Inter-American Systems are studied in order to verify their interpretative evolution towards the prohibition of discrimination against people based on their sexual orientation and gender identity. Besides, it also studies the Soft Law principles for the protection of persons deprived of their liberty and compiles the main specific standards on the differential treatment of LGBTI people in prisons issued by the Inter-American Court of Human Rights and their application in some Latin
American countries.
