Abstract

This article explores the autonomy between the Right to Truth and the Right to Justice for victims of human rights abuses, utilizing a comparative analysis of the doctrinal development within the United Nations, and the jurisprudence of the regional systems. The constant development of independent conceptual bases and obligations indicates a marked autonomy between both rights. The identified intersections suggest that, at the individual level, the duties to investigate and punish can be satisfied through a single procedural motion. Collectively, Truth Commissions may contextualize criminal proceedings through deliberate coordination between both mechanisms.
