The pre-existence of historical identities (indigenous people, indigenous peoples). An unfinished right on the part of States in South America

The objective of the article is to propose a concept of pre-existence and the elements that compose it for the historical identities of South America, called: indigenous, indigenous peoples. For two reasons: a) because they have been curtailed by internal divisions of the States and the territorial borders of two or more countries, b) because the constitutional and international regulations do not recognize this right appropriately. The method used were previous works of the author on the Aymara, Quechua, Kichwa (2012-2016) and Ayoreo (2020-2021). Finally, solutions for this recognition are presented: the emancipation of these identities and the constitutionalization of Historical Rights.
