The objective of this work is to reflect on the gender stereotypes included in the argument, based on the use of the gender perspective, which will reveal that by using these preconceptions about women (characteristics, attributes and roles) the judiciary makes explicit the patriarchal pact, but at the same time through the motivations that justify a decision they can collaborate in the eradication of gender stereotypes.
