The accommodation of religious laws in cross-border situations: the contribution of the Hague Conference on Private International Law

Abstract

The interconnection of the world today can be observed in all the spheres of human activity. Nevertheless, planet Earth is still divided in a diversity of countries with its own laws and courts. It can create problems for individuals who are involved an international life. The so-called Clash of Civilizations that can arise between the legal western culture and the Muslim legal culture can be overcome by the work of some international organisations as The Hague Conference of Private International Law. The Conference has stimulated the signature of legal instruments to regulate adequately the legal effects in Europe of the unilateral divorces or repudiations, the protection of minors abandoned in international cases and the right of access to the children even in cross-border cases.
