Abstract

The “Instrucción DGRN” of October 5, 2010 on filiation by surrogacy (Spanish Official Journal BOE October 7, 2010) tried to provide legal certainty with regard to children born abroad. This “Instrucción” presents numerous operative limits. In particular, the requirement of a foreign judicial decision on filiation in these cases ignores the Spanish legal rules of Private International Law and reates a wall of bureaucracy which is not consistent with the superior welfare of the child.
