In its judgment of 17 November 2011, C- 327/10, Lindner, the ECJ established that Regulation 44/2001 does not oppose the application a provision of national law of a Member State enables proceedings to be brought against persons whose domicile is unknown. Also the Court reiterates that the application of the rules of jurisdiction of the Brussels I Regulation requires the existence of an international element, offering a particular interpretation of the forum article 16(2) of the Regulation with a view to avoiding situations of the denial of justice of the applicant.
