Abstract
The deep transformation of the economy has serious impacts on the performance of companies. To accommodate the needs of the globalized market that involves articulating different business strategies, as well as affecting its structure, organization and operation, also project on industrial relations that they develop. In this framework, we intend to discuss some issues from the perspective of private international law raised by the protection of workers affected by those business strategies trying to verify whether the solutions adopted in our legal system reconcile worker protection, the weaker party legal relationship, as of right to work ex Article 35 CE with free enterprise Article 38 CE.
