Abstract

The Court of Luxembourg has pronounced in the sentence van Ardennen to interpret, restrictively, the faculties with which the States count in order to limit the economic guarantees of the workers in case of insolvency. Thus, it has been understood that the Directive 80/987 precludes a national rule decreasing the sum guaranted by the Directive when the worker did not register as a job seeker within the prescribed time limit.
