Primera ejecución forzosa conocida de un laudo arbitral ciadi en España (Víctor Pey Casado y Fundación Presidente Allende C. República de chile): sin exequátur

Abstract

Resumen: El Juzgado de Primera Instancia nº 101 de Madrid ha otorgado la ejecución forzosa de un laudo dictado en el caso CIADI Víctor Pey Casado y Fundación Presidente Allende c. República de Chile sin exigir la presentación de un exequátur previo del laudo, tal y como dispone el artículo 54.1 del Convenio CIADI. Ha sido la primera vez que se ha presentado ante un tribunal español una solicitud de ejecución forzosa de un laudo CIADI. El Juzgado de Primera Instancia ha ordenado el embargo de bienes del Estado chileno en España por más de tres millones de euros. Simultáneamente, Chile ha intentado reducir la cantidad a pagar a los demandantes apelando a otras dos decisiones CIADI que deberían ser consideradas como laudos bajo el Convenio CIADI.

Abstract: The Court of First Instance No. 101 of Madrid has granted leave for execution for an award rendered in ICSID case Víctor Pey Casado and President Allende Foundation v. Republic of Chile without requesting the submission of any previous exequatur for the award, as provided for by Article 54(1) of the ICSID Convention. This has been the first time that such a request for enforcement and execution of an ICSID award has been filed with a court of justice in Spain. The Court of First Instance has ordered the seizure of Chilean assets in Spain worth more than 3 million euros. Simultaneously, Chile has tried to reduce the amount to be paid to the claimants by resorting to two other ICSID decisions that should be regarded as awards by the ICSID Convention.
