La sentencia del Tribunal Supremo de 12 de enero de 2015. Derecho Sucesorio Internacional y lectura económica del reenvío
Abstract
El Tribunal Supremo en su sentencia de 12 de enero de 2015 vuelve a poner de relieve la importancia práctica que tiene el mecanismo jurídico del reenvío. El reenvío sigue vivo y sirve para corregir y modular en el ámbito sucesorio al artículo 9.8 del Código Civil, cuando la situación jurídica internacional presenta vínculos más estrechos y profundos con nuestro país que con el país de la nacionalidad del causante. Se hace un análisis de lo que el Tribunal Supremo expone en este caso, y también de los cambios que se producirán con la aplicación del Reglamento Sucesorio Europeo en relación con el mecanismo jurídico del reenvío.

Abstract: The judgment rendered on January 12, 2015 by the Spanish Tribunal Supremo (Supreme Court) deals once again with the practical importance of the renvoi. The renvoi still survives and keeps acting as a correction to the regulation of article 9.8 of the Spanish Civil Code, in cases where the legal international situation shows closer and deeper connections with Spain than with the country of the deceased’s nationality. The present paper explains the doctrine of the decision of the High Court in this case. It also deals the coming changes to arrive from the application of the new European Succession Regulation regarding the renvoi.
