The “supreme court” of Facebook: a new step towards justice without the state

Abstract

This study introduces the reader to the nature and functioning of the “Supreme Court” of Facebook, as a new online method of alternative dispute resolution. The lack of State regulation in the virtual world has benefited the development of new systems of “private justice” offering its users faster and more effective solutions to their conflicts. This phenomenon, initially limited to protecting property rights, has evolved including personality rights, freedom of expression and freedom of business. The raise of non-jurisdictional organs specialized in this subject offers important advantages as an alternative to the traditional “public justice”, which can lead us in the future to a reconceptualization of the legal practice, in which the training on lex electronica and social media procedures will be a must.
