Abstract

The judgement of the Islas Baleares provincial court of 27th april 2021 has confirmed on appeal that a Spanish woman registers as her daughter a girl born through a surrogacy contract entered into in Russia.   This sentence is especially relevant, because the recognition of the parentage of a Russian minor in favor of the Spanish intending mother is being allowed, without, in principle, providing a judicial sentence in which the fact of the parentage is verified with validity legal; and without any biological link between the two. It is therefore a completely different case from those brought before the European Court of Human Rights or before the Supreme Court.
