Recognition in the European Union of the filiation of children of same-sex couples

Abstract

European Union law seeks to promote not only the free movement of persons, services and capital, but also the free movement of legal products and legal situations, such as filiation, name, legal persons, inheritance, among others. However, it is important to recognise that LGBTI people may face difficulties when crossing borders within the EU due to the lack of recognition or protection of their relationships and their legal effects in some member countries. While free movement of people is a fundamental EU principle, full equality and recognition of LGBTI rights in all Member States can still be a challenge. And in this work the focus will be on the recognition of filiation and children of same-sex couples.
