Anti-arbitration injunction and International Legal Cooperation Act
Abstract
Recently a Court of First Instance of Madrid rejected the recognition in Spain of an Anti-arbitration injunction issued by a third State (a non-EU Member State). This is the irst Spanish jugdment that has addresses such a controversial issue. Although the resolution is certainly brief, it is worth taking the opportunity to consider in some detail and to generalize whether these types of mea-sures or judicial resolutions are or are not recognizable in Spain in the application of the International Legal Cooperation Act.
