Abstract

This paper analyzes the principle of equality recognized by the Italian Constitution as a norm of principle as well as a subjective right. The effects of this principle on jurisdiction and legislation are also studied. The author links the principle of equality to the principle of reasonability and explains the way in which loopholes are produced and how they can be resolved. Finally, he explains the principle of equalization and its tension with the principle of equality.
