Abstract

Popular constitutionalism is a contemporary constitutional theory with a critical view of U.S’ constitutional narrative focus on judicial supremacy. Instead, popular constitutionalism regards the people as main actor. It defends an anti-elitist understanding of constitutional law. From the institutional perspective, popular constitutionalism proposes a weak model of constitutionalism and a strong participatory democracy.
