La nueva regulación de la filiación natural en el derecho internacional privado español = The new regulation of the natural filiation in the Spanish international private law
Resumen
Resumen: La regulación de la filiación natural en el ámbito del Derecho internacional privado, ha sido reformada por la Ley 26/2015, de 28 de julio de modificación del sistema de protección a la infancia y a la adolescencia. En este trabajo se analizan las soluciones propuestas por el legislador, dirigidas a la consecución del favor filii, a través de una norma de conflicto materialmente orientada, y las consecuencias que se derivan de la misma. Asimismo, se pone de relieve la discordancia que se aprecia en la nueva regulación en relación a los diferentes aspectos de la filiación.

Abstract: The article 9.4 of the civil Code, which regulates the law applicable to the natural filiation, has been recently modified for the Law 26/2015, of July 28 of modification of the protection system to the infancy and to the adolescence. In this study we are analyzed the solutions proposed by the legislator which go to the attainment of the favor filii through a rule of conflict materially oriented and the consequences that derive from the same. On the other hand, there is emphasized the incoherence that it appreciates in the new regulation in relation to the different aspects of the filiation regulated by the new norm.
